APRN Independent Practice Updates 2026: What NPs in California, Oklahoma, and Wisconsin Need to Know

The regulatory landscape for advanced practice registered nurses is shifting faster than at any point in the past decade. Three states — California, Oklahoma, and Wisconsin — have each passed significant legislation expanding APRN independent practice authority, with changes taking effect between late 2025 and 2026. For NPs in these states, or NPs considering relocating, understanding what changed and what it takes to qualify is essential.

There's also a broader takeaway that applies to NPs everywhere: the supervised clinical hours required to unlock independent practice in each of these states look a lot like an NP residency. Post-graduate training isn't just a career accelerant — in many states, it's now part of the legal pathway to full autonomy.

California: AB 890 and the 103 vs. 104 NP Distinction

California's Assembly Bill 890 created two new categories of nurse practitioner licensure that fundamentally changed how NPs in the state practice — and how they advance.

California AB 890 — Two-Tier NP Licensure

  • 103 NPs: May practice without standardized procedures, but only within California Board of Nursing-approved group settings such as health system clinics or medical groups. Subject to statutory scope and setting limitations.
  • 104 NPs: Eligible for independent practice outside approved group settings after working full-time for 3 years or 4,600 hours as a 103 NP in good standing. Must still practice within their education, training, and national certification.

Because the 103 NP pathway launched in 2023, the first cohort of NPs became eligible for 104 licensure in 2026. If you're a California NP who has been accumulating hours in an approved group setting, now is the time to review whether you qualify and begin the application process.

Residency connection: A California NP residency completed within an approved group setting counts toward your 103 NP hours. A 12-month full-time residency (~2,000 hours) gets you nearly halfway to the 4,600-hour threshold from day one of your career.

Oklahoma: Independent Prescriptive Authority Under HB 2298

Oklahoma House Bill 2298 took effect November 1, 2025, removing the previous legal requirement for physician supervision when APRNs prescribe. Eligible APRNs can now apply for independent prescriptive authority through the Oklahoma Board of Nursing nurse portal.

Oklahoma HB 2298 — Eligibility Requirements

  • Valid APRN license in good standing
  • Completion of at least 6,240 supervised clinical practice hours with prescriptive authority
  • Applications submitted through the Oklahoma Board of Nursing portal

It's important to note that HB 2298 does not expand the types of drugs APRNs can prescribe. APRNs remain prohibited from independently prescribing Schedule II controlled substances. The law removes the supervision requirement for prescribing; it does not remove existing formulary restrictions.

Wisconsin: The APRN Modernization Act (AB 257)

Wisconsin passed Assembly Bill 257 — the APRN Modernization Act — allowing qualified APRNs to practice independently without a collaborative practice agreement beginning September 1, 2026. The Wisconsin Board of Nursing is currently finalizing the rules and application process.

Wisconsin AB 257 — Dual Hour Requirements

  • 3,840 hours of professional nursing in a clinical setting, spanning at least 24 months
  • 3,840 hours of APRN practice in your recognized role while working with a physician or dentist immediately available for consultation, spanning at least 24 months
  • Both conditions must be met — not just one

Wisconsin's law includes specific carve-outs for pain management. APRNs using invasive techniques for pain management must collaborate with a qualified physician unless treating in a hospital setting or holding hospital privileges for such treatment. Certified Nurse Midwives have a separate exception pathway for births outside hospital settings.

Employers may also impose additional limitations on independent APRNs as a condition of employment or contract — something worth reviewing carefully before assuming full autonomy at a new position.

What Healthcare Organizations Need to Do

For APRNs and the healthcare entities employing or contracting with them, these changes come with real compliance responsibilities:

  • Update governance structures and agreements. Review collaborative practice arrangements, credentialing systems, and contracts to reflect current law in each state where you operate.
  • Verify licensure and hours. Don't assume an APRN qualifies for independent practice — verify practice hours and licensure category through documented proof before granting autonomy.
  • Revise prescribing policies. Review delegation systems and oversight structures to align with expanded scopes, particularly in Oklahoma where prescriptive authority changes took effect in November 2025.
  • Check payor contracts and malpractice policies. Some contracts and malpractice policies contain supervision requirements or restrictions that may now conflict with state law. These need to be reviewed and renegotiated as appropriate.
